Barclays fined $3.75 million for failing to retain records

The Financial Industry Regulatory Authority on Thursday said it fined Barclays Capital Inc. almost $4 million for what it called "systemic failures" in records retention.

FINRA, the largest independent regulator for securities firms doing business in the U.S., fined the London-based bank $3.75 million after an investigation found that the firm failed to preserve electronic records, emails and instant messages for the required minimum time of 10 years.

Providing additional evidence that the Obama Administration's Department of Justice (DOJ) is protecting "banks too big to fail," Pulitzer Prize winning financial reporter David Cay Johnston has revealed that the DOJ has refused to force JPMorgan Chase to comply with an ongoing investigation into the bank's possible knowledge of Bernard Madoff's fraud scheme of a few years ago.

The information obtained might reveal that the bank chose to financially benefit from criminal activity.

About 15 months after getting slapped around by the Consumer Financial Protection Bureau to the tune of $112.5 million for a variety of bad business practices, the CFPB put another huge lump of coal in American Express’s Christmas stocking, spanking the credit card company for nearly $70 million, including $59.5 million in refunds to customers.

Once again, one of the big issues in this latest CFPB action is the deceptive marketing of “add-on” products for Amex’s credit cards. These include things like payment protection and credit monitoring services.
