Supreme Court hands Monsanto victory over farmers on GMO seed patents, ability to sue

The US Supreme Court upheld biotech giant Monsanto’s claims on genetically-engineered seed patents and the company’s ability to sue farmers whose fields are inadvertently contaminated with Monsanto materials. The high court left intact Monday a federal appeals court decision that threw out a 2011 lawsuit from the Organic Seed Growers and Trade Association and over 80 other plaintiffs against Monsanto that sought to challenge the agrochemical company’s aggressive claims on patents of genetically-modified seeds. The suit also aimed to curb Monsanto from suing anyone whose field is contaminated by such seeds.

 

The group of plaintiffs, which included many individual American and Canadian family farmers, independent seed companies and agricultural organizations, were seeking preemptive protections against Monsanto’s patents. The biotech leviathan has filed over 140 lawsuits against farmers for planting the company’s genetically-engineered seeds without permission, while settling around 700 other cases without suing.

The seed-giant and GMO evil genius Monsanto is promising to appeal a recent decision by a labor appeals court in Argentina to stop construction of a seed-manufacturing plant there. Activists filed the initial complaint to put the brakes on the factory, citing health and environmental concerns associated with genetically-modified crops and their production. But Monsanto is fighting back.

Farmers rallied outside the European Parliament on Monday in protest of a proposed law they say would threaten biodiversity and put multinational control over seeds. For consumers, Ben Raskin of the UK-based charity Soil Association writes that "If this law goes through, it is likely you will be paying more for a smaller choice of seeds and plants from fewer, larger companies."

 

In addition to drawing attention to these issues ahead of the vote on the legislation, the peasant advocacy group is championing the role of small farmers at the start of what the UN has dubbed as International Year of Family Farming.

China has struggled to keep genetically modified foods out of their country, rejecting and even incinerating US shipments of corn by the boatload this year. But some of the seeds may have made their way in regardless, and it’s these US-made seeds that are being blamed for crop failure in the large eastern country.

 

Police in the Hunan province have busted a seed smuggling case that may have contributed to the failure of 200 acres of corn in Tongdao last year. Called “US golden corn” by local officials, the seeds originate from giants like Monsanto and Syngenta.

Monsanto would have you believe that their seeds cause no risk to modern agriculture, that they are simply trying to provide the best products to feed the world. But, both in the lab and in the fields, we’ve seen this to be far from true. Worse, GMOs are contaminating conventional fields, and leaving some farmers with no choice as to what they grow. This has led to numerous farmers joining forces, filing lawsuits against Monsanto to protect themselves.
